Total-Loss Claims After the Class-Action Blockade: The Policyholder’s Valuation Fight

Six circuits have slammed the class-action door on total-loss undervaluation — the individual claim is now the policyholder’s path. Walk out able to audit a CCC ONE valuation, sequence appraisal against a badfaith suit, pick state or federal forum, and pursue extracontractual damages.

Course Overview

The class action is closed. The individual claim is now the whole case

2026-09-17 12:00:00

After six circuits rejected class certification in total-loss TNA cases, the class vehicle is effectively closed. The recovery path now runs through the individual claim: one policyholder, one underpaid total-loss valuation, one insurer. This program is built for that fight, not the class theory that no longer survives.

The mechanics are unforgiving. Invoke appraisal carelessly and Stewart v. Farmers can moot your breach and bad-faith claims. Misread Eddy v. Farmers and you surrender the claims-file discovery you need. Pick the wrong forum and CAFA removal drags you into federal court. Miss your state’s appraisal and bad-faith rules and the extracontractual damages simply vanish.

You leave with a CCC ONE audit checklist and a counter-valuation framework built on NADA, KBB, Autotrader, and Manheim data. You also leave with a sequencing playbook for appraisal, forum selection, and extracontractual damages. This is practitioner work product, not a doctrine tour.

Key topics that will be covered

01
The New Primary Path
Reframe the matter as an individual underpayment claim now that six circuits have rejected class certification in total-loss TNA cases and target the recovery that survives the blockade.
02
Decoding CCC ONE
Obtain and read a full CCC ONE Market Valuation Report line by line, so you know which entries to audit first and why the platform’s scale drives the underpayment problem.
03
Attacking the Deductions
Challenge the three deductions litigators target most — Projected Sold Adjustments, condition adjustments, and comparable-vehicle-selection errors — and build a counter-valuation from NADA, KBB, Autotrader, and Manheim data.
04
Choosing the Forum
Decide state versus federal court with CAFA removal risk and the local-controversy exception in view, using state regulatory variance to keep the case where your client is strongest.
05
Appraisal Without the Trap
Trigger and control the appraisal proceeding, from umpire selection to current state legislative developments, and sequence it so Stewart v. Farmers cannot moot your breach and bad-faith claims.
06
Building the Bad-Faith Case
Assemble the extracontractual record — pre-appraisal insurer conduct, ACV methodology flaws, delay — win the claims-file discovery fight under Eddy v. Farmers, and know which states put punitive damages on the table.

Auditing the Algorithmic Total-Loss Valuation and Picking the Forum

This session teaches policyholder attorneys how to systematically audit a CCC ONE Market Valuation Report, identify the three algorithmic deductions most commonly attacked in litigation—Projected Sold Adjustments, condition adjustments, and comparable vehicle selection errors—and build a counter-valuation. It also covers forum selection strategy, including CAFA removal risk, the local controversy exception, and state regulatory variance that creates forum-shopping opportunities. Attorneys will leave with a practical audit checklist and a framework for deciding whether to file in state or federal court given the class-action blockade created by insurer-invoked appraisal clauses.

Appraisal Demands and the Individual Total-Loss Lawsuit

This session equips policyholder-side attorneys with the complete toolkit for pursuing individual total-loss underpayment claims after class certification has been blocked. Attendees will learn how to sequence appraisal demands against individual lawsuits, navigate the mootness trap created by Stewart v. Farmers, and build bad-faith cases that survive appraisal completion. By the end of this session, attorneys will be able to evaluate jurisdiction-specific appraisal mechanics, anticipate discovery disputes under Eddy v. Farmers, and assess when extracontractual damages — including punitive damages — are available.
