A Litigator’s Guide to the Federal Rules from Inception to Trial

Frank Nolan | Eversheds Sutherland

Resident in the firm’s New York City office, represents companies in class action and commercial litigation in federal and state courts across the country, arbitrates domestic and international business and reinsurance disputes, and counsels clients on pre-litigation and compliance matters.

Frank has particular expertise in the insurance industry and has also represented clients in litigation and arbitration across a wide range of other sectors, including life sciences, banking, manufacturing, technology, biometrics, and aeronautics. As part of his consumer class action defense practice, Frank is a founding member of Eversheds Sutherland’s biometrics team, which counsels clients employing biometric technology and defends against litigation arising from biometric protection and other privacy and data security laws. He is also a member of the Firm’s Telephone Consumer Protection Act (TCPA) team.

Prior to law school, Frank worked as a policy analyst for the United States Department of Defense, first with the Under Secretary of Defense for Acquisitions and later for the Assistant Secretary of the Army for Acquisitions.

Frank is a member of the firm’s pro bono committee and has represented numerous clients seeking asylum under the United Nations Convention Against Torture. He also holds leadership positions in community-focused organizations, including serving as a member of the Board of Trustees of Trail Blazers, a 132-year-old not-for-profit organization that maintains a portfolio of summer and year-round scholarship-centric camp and after school programs rooted in outdoor experiential education, social-emotional learning, and leadership development.

Jocelyn Weinstein | Eversheds Sutherland

Advises domestic and multinational clients on an array of construction, business, and commercial litigation matters. Her experience includes litigating a wide range of construction and commercial disputes, such as claims for delay, loss of productivity, and incomplete or defective work, in the state and federal trial and appellate courts of New York. Additionally, Jocelyn regularly represents clients in a variety of alternative dispute resolution processes, including in arbitrations and mediations. Prior to joining Eversheds Sutherland, Jocelyn was an associate in the New York office of an international law firm, as well as at a boutique commercial litigation firm.

Alex Fuchs | Eversheds Sutherland

Advises insurance companies on complex, large-scale litigation matters. He focuses his practice on defending challenges to insurers’ business practices in class action cases and coverage disputes. He also assists clients with defense of tort, contract, and subrogation matters in New York state and federal court. Prior to joining Eversheds Sutherland (US), Alex was an associate in the insurance litigation group at an international law firm in New York. His previous experience includes counseling London market insurers in the defense of complex product liability actions, including matters involving aviation, government contractors defense, the Death on the High Seas Act, the General Aviation Revitalization Act and corporate successor liability.

Kym Kochis | Eversheds Sutherland

Co-head of Global Litigation, counsels insurers on a wide range of litigation and corporate governance matters and is co-head of our insurance litigation and class action groups. Her extensive knowledge of the insurance industry provides for deft representation of insurers opposing complex class action litigation.

She regularly handles matters involving unfair trade practices, consumer fraud, antitrust and policy coverage issues, as well as complex breach of contract and tort claims. In tune with emerging issues affecting the industry, Kym regularly authors publications about insurance business practices and class action defense. Most recently, she provided supplementary testimony on Rule 23(f) of the Federal Rules of Civil Procedure.

Kym joined Eversheds Sutherland (US) from an international law firm in New York, where she was a partner and co-chair of the insurance litigation and regulatory practice. She previously was an attorney at Dewey & LeBoeuf LLP. Earlier in her career, Kym gained significant experience in the London Market during a secondment with a leading Lloyd’s of London syndicate. There, she was responsible for all aspects of the syndicate’s major claims, which included directors and officers (D&O), professional liability, property and marine claims. Her duties also involved providing U.S. compliance and regulatory advice, responding to Department of Insurance inquiries, and collaborating with the syndicate’s underwriters to develop U.S. policy wordings.
