Program Summary

Divorce and child custody laws encourage the close and continuing contact of both parents with their minor children after the entry of a divorce judgment. How can that presumption be overcome? In what circumstances do courts find it to be in the children’s best interests to relocate with one parent out of state, and as a result leave the other parent behind? This presentation will examine the important considerations in building a successful relocation case, and how litigants and their attorneys can best prepare for this extremely contentious zero-sum litigation.

Key topics to be discussed:

  • The key roles of remarriage and employment in relocation cases
  • Forgiveness vs. Permission: when parents move before seeking relocation
  • Education and a child’s bests interests
  • What is a workable interstate parenting plan?
