Program Summary

Ruth Carter
There is a reason why the lawyer stereotype is that we are liars and slimeballs – because some of us are. There is no excuse for acting like a jerk, and indeed, doing so can not only hurt your reputation, but also your client’s case. In this session, we will discuss how:

  • Assertiveness is more effective than assholery
  • We have a responsibility to discourage jerk behavior from your clients
  • Ways to respond to jerk behavior from opposing counsel.

Stephan Futeral
Unfortunately, lawyers throughout the country are not exactly revered for their congenial nature or their civility toward each other. To make matters worse, TV, movies, and dramatic fiction play to an audience that expects lawyers to shout at the witness during cross-examination – “YOU CAN’T HANDLE THE TRUTH!” The unfortunate “truth” is that even in the real world, many lawyers market themselves as being “aggressive” or they are endorsed by other lawyers as such. In this presentation, we will cover whether an aggressive approach to practicing law is an effective approach. Additionally, we will identify the types of challenging lawyers and cover practical pointers for dealing with a difficult lawyer.
