With every presidential election the energy and manufacturing industry prepares for shifts in policy based on the interests and vision of the upcoming administration. The results of the 2020 election cycle, in particular, have energy companies bracing themselves for the possibility of significant overhauls to federal policies, legislation, and initiatives that, for the past four years, have provided significant opportunities for energy infrastructure development. The presenters in this webinar will provide a post-election snapshot, discussing how key environmental issues within the energy sector might be impacted by a Trump or Biden win and by a potential change of control in the Senate. Topics include: climate change policy, enforcement, rule overrides, executive orders, and key legislative committees. A portion of the program will focus on how these issues impact development in the Gulf Coast.

Robert “Bob” Holden | Partner in Jones Walker’s Litigation Practice Group and is co-team leader of the firm’s environmental litigation team

He counsels clients on environmental regulatory compliance, enforcement actions, and related commercial litigation and represents businesses in the energy, chemicals, manufacturing, and other industries with significant operations across the southeastern United States and in the Gulf of Mexico. He regularly counsels clients on a broad range of environmental and regulatory requirements in relation to air (including Clean Air Act Title V, Maximum Achievable Control Technology (MACT), and New Source Review (NSR) Standards); wastewater (including the Louisiana Pollutant Discharge Elimination System (LPDES) and Gulf of Mexico General National Pollutant Discharge Elimination System (NPDES) permit programs); hazardous waste (with a particular focus on generator issues); and solid-waste (including permitting and closures). He also provides advice to OCS operators on Bureau of Safety and Environmental Enforcement (BSEE) operational rules. Bob has represented numerous clients in enforcement proceedings before EPA headquarters, EPA Regions 6 and 8, and before the Louisiana Department of Environmental Quality (LDEQ).

Jim splits his time between the firm’s Washington DC and Houston offices. Jim has a robust government relations practice and has developed extensive, deep relationships in the oil and gas, maritime, and construction industries. Among recent, high-profile engagements, he was appointed as primary advocate and spokesman for energy-industry participants following the Macondo oil spill. Jim also has extensive, global experience representing the interests of major, multinational corporations as well as industry groups with respect to major transactions, contracts, and disputes. He has acted as lead negotiator and senior attorney in numerous transactions, including multibillion-dollar sales, acquisitions, and mergers. Meghan Smith | Partner in Jones Walker’s Litigation Practice Group and is co-team leader of the firm’s environmental litigation team

She focuses her practice on environmental/toxic tort, energy, and construction litigation and arbitration. Meghan also advises clients on regulatory compliance and permitting issues at the state and federal level for both active facilities and remediation projects. Meghan has worked in defense of numerous major corporations, including oil and gas companies, chemical manufacturers, and engineering/construction firms in state and federal litigation and private arbitration. Recent examples include representing various clients in defense of claims arising from an industrial brine mine collapse; releases from refineries and other petrochemical manufacturing facilities; alleged onshore contamination and coastal erosion from historical and active oil and gas exploration and production operations; personal injury claims related to workplace and secondary exposure to raw materials and byproducts, sudden-occurrence incidents in industrial settings, and offsite injuries; design defect claims; professional negligence claims; and construction defect claims. Meghan is licensed to practice in Louisiana and Texas.
 
 

Accreditation Policy
myLawCLE seeks accreditation for all programs in all states. (Accreditation for paralegals sought thru NALA and NFPA paralegal associations.) Each attending attorney/paralegal will receive a certificate of completion following the close of the CLE program as proof of attendance. In required states, myLawCLE records attorney/paralegals attendance, in all other states attorney/paralegal is provided with the approved CLE certificate to submit to their state bar or governing association.

    Automatic MCLE Approvals

All myLawCLE CLE programs are accredited automatically either directly or via reciprocity in the following states: AK, AR, CA, CT, FL, HI, ME, MO, MT, ND, NH, NM, NJ, NY, and VT. (AZ does not approve CLE programs, but accepts our certificates for CLE credit.)

    Live Video Broadcasts

Live video broadcasts are new live CLE programs being streamed and recorded for the first time. All of these programs qualify for “Live” CLE credit in all states except NV, OH, MS, IN, UT, PA, GA, and LA —these states require in-person attendance to qualify for “Live” CLE credit.

    “Live” Re-Broadcasts

“Live” Re-broadcasts are replays of previous recorded CLE programs, set on a specific date and time and where the original presenting speakers calls in live at the end of the event to answer questions. This “live” element allows for “live” Re-broadcast CLEs to qualify for “Live” CLE credits in most states. [The following states DO NOT allow for “live” CLE credits on re-broadcast CLEs: NV, OH, MS, IN, UT, PA, GA, and LA]

Reciprocity
Many states allow for credit to be granted on a 1:1 reciprocal basis for courses approved in another mandatory CLE jurisdiction state. This is known as a reciprocity provision and includes the following states: AK, AR, HI, CT, FL, ME, MO, MT, ND, NH, NM, VT, NJ, and NY. myLawCLE does not seek direct accreditation of live webinars or teleconferences in these states.
