Program Summary

This program will cover some of the common challenges employment attorneys address and practical considerations while complying with ethical obligations. We will look at considerations in the litigation context, particularly related to joint representation and discovery; in the advisory context, particularly considering social media usage; and in the context of workplace investigations in response to employee complaints.

Key topics to be discussed:

  • Identify common ethical pitfalls in representing multiple plaintiffs and in representing multiple defendants
  • Discuss common ethical pitfalls in workplace investigations
  • Explore ethical problems in dealing with social media and unrepresented complainants
  • Review and discuss rules involving litigation holds, electronically stored information, and inadvertent disclosure

Tracey I. Levy is the Founding Member of Levy Employment Law and has been annually recognized by Super Lawyers for the New York Metro Area since 2016. She leverages more than 25 years of combined experience in employment law and employee relations to provide managers and HR professionals with practical advice on workplace-related issues, and support businesses with HR policies and agreements. Tracey regularly conducts workplace investigations, and as a Co-Founder of Impact Workplace Training, she trains employees and managers on appropriate workplace conduct. Complementing her legal practice, Tracey is also an educator with the Scheinman Institute’s professional programs at Cornell University ILR School in Manhattan. Her past experience includes both large law firm practice and working in-house at a financial services firm. Tracey holds an advanced law degree from Yale Law School’s LLM program, and a JD from Albany Law School.

Simone Handfield is Senior Counsel with Levy Employment Law, where she regularly advises clients on a variety of employment matters, focusing primarily on workplace investigations, anti-harassment training and counseling. Simone’s career has spanned practicing with the New York State Department of Law, working in the labor and employment law departments at two global law firms, serving as in-house employment counsel for a global financial services firm, and working with a smaller local employment law firm. Simone earned her law degree from Syracuse University College of Law.

Howard Schragin is a founder and the Managing Partner of Sapir Schragin LLP in White Plains, New York. Gayle Wasserman is an experienced management-side employment attorney, human resources consultant, and workplace trainer in New York. She is the founder of Wasserman Law LLP, where she regularly performs complex investigations into all aspects of employee misconduct and advises clients on workplace policy issues. Gayle is also the co-founder of Impact Workplace Training, where she conducts myriad of workplace trainings, including respectful workplace (harassment and discrimination), communication and management training sessions and individualized coaching (in person and virtually). Additionally, Gayle also is an Educator – Professional Programs with Cornell University ILR School’s Scheinman Institute in Manhattan, where she teaches several classes focusing on HR law compliance, investigations, harassment prevention and effective employee relations. Gayle earned her law degree from New York University School of Law and received her undergraduate degree with honors in Organizational Studies from the University of Michigan.
