This session examines HIPAA’s scope and limitations, recent enforcement trends, and the growing gap between protected health information and unregulated consumer health data. Attendees will explore de-identification strategies, health privacy litigation damages, and emerging federal and state legislation addressing data outside HIPAA’s reach.
A short intermission allowing attendees to refresh and prepare for the second session. Use this time to reflect on key takeaways from Session 1 and formulate questions for upcoming discussions.
This session dives deeper into individual privacy rights under HIPAA and state laws, confidentiality protections for sensitive data including substance use disorder records under Part 2, mental health, and biometric information. Attendees will also examine AI implications for regulated health data and best practices for vendor compliance and downstream privacy protections.
Requirements
The Alabama State Bar MCLE Commission requires attorneys to complete 12 credits, including 1 ethics, by December 31 of each year. All credits must be reported by February 15 of the following year. A maximum of 12 credits, including 1 ethics credit, may be carried over for 1 year only.
