Annette provides proactive counseling and litigation advice to employers on workforce strategies that leverages the use of data analytics, with an emphasis on pay equity, diversity and inclusion, and people analytics.

As co-leader of Seyfarth’s People Analytics group, Annette leads a multidisciplinary team of attorneys, labor economists, data analysts, and other professionals to develop data-driven solutions that solve complex workforce issues. Annette collaborates with employers to design and implement metrics for tracking, assessment, and achievement of workforce objectives including effective talent acquisition and management, pay equity, diversity and inclusion, and workforce restructuring with an eye toward minimizing litigation risk.

Annette uses her substantive experience to defend employers in complex litigation matters that implicate the cross-section of data and the law. Such issues include defeating class certification, developing merits-based analyses, and evaluating damages assessments that impact litigation defense and settlement options.

In her practice, Annette is on the cutting edge of providing legal advice related to the technological advances that are driving data-driven decision-making in the employment context. These technologies include the use of artificial intelligence, predictive analytics, and machine learning algorithms to address key processes including sourcing, hiring, retention, workforce planning, employee engagement, and diversity and inclusion efforts.

Annette also represents federal contractors on their obligations under Executive Order 11246 and related statutes and regulations. She assists contractors in affirmative action compliance matters involving OFCCP proceedings, including compliance evaluations, and pre-audit review and analysis of general compliance obligations.

Annette has also provided written and oral testimony on proposed labor and employment legislation and regulations pending before the United States Senate, House of Representatives, and the Equal Employment Opportunity Commission.

Annette is a member of the Chicago Diversity Action Team, supports the firm’s national Diversity leadership, and actively participates in pro bono and other community charitable activities.

Every organization faces a wide array of people challenges. Labor and employment laws and regulations are as complex and ever-evolving as the people who make up the organizations.

Brandon assists clients by understanding their unique needs and goals, and tailors his advice and litigation strategies to meet those needs and goals. Brandon represents and counsels employers on a diverse range of human resources and labor relations topics.

His practice focuses on individual and complex employment litigation under various statutes including Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act, the Americans with Disabilities Act, and the Fair Labor Standards Act. In addition, a portion of Brandon’s practice is dedicated to labor relations matters.

Brandon has successfully tried multiple cases before juries in federal court, including matters involving allegations of sexual harassment and race discrimination under Title VII. He also has extensive experience litigating and counseling companies on joint employer issues under the NLRA and FLSA.

Brandon’s educational background in human resources has given him insight into a human resources professional’s perspective, and helps him bridge the gap between attorneys and their HR counterparts. Brandon finds Seyfarth attorneys’ knowledge and passion for labor and employment both motivating and rewarding.
