Program Summary

Congress made the most significant changes to trademark law in decades as part of the bipartisan coronavirus relief bill. The changes, currently scheduled to go into effect at the end of 2021, are intended to streamline USPTO procedures to remove fraudulent applications and unused registrations from the registry; restore the rebuttable presumption of irreparable harm in trademark cases; and provide new tools for challenging filings.

Key topics to be discussed:

  • Changes in trademark prosecution
  • Cancellations and Ex parte proceedings
  • Letters of Protest
  • Litigation
