Program Summary

Nearly every business is now impacted by consumers' use of brands in search and keyword advertising. This CLE will cover the policies, case law and practical implications with use of brands in platform search and keyword advertising through search engines, ecommerce sites, social media and other platforms. Discussion will include best practices to protect one’s brand, but also what the parameters are for us of other brands. The panelists have unique perspectives, having worked at ecommerce and social media platforms. The panel will also offer an international perspective, as marketing programs and projects are increasingly global in scope.

Steve is the founding partner of Coates IP, an international intellectual property boutique located in the US, Mexico and Colombia, where he specializes primarily in trademarks, domain names and copyright. He is active in Internet governance policy, currently as a member of the Intellectual Property Constituency of ICANN, and previously as a member of the Business Constituency, and the ICANN Nominating Committee. Steve currently sits on the advisory board of the NYU Law Engelberg Center on Innovation Law & Policy. He is also very active at the International Trademark Association, where he has been a committee member since 2007, and led a domain name subcommittee on new gTLDs. Prior to Coates IP, Steve was Senior Counsel at Amazon.com where he managed the trademark practice for Amazon’s digital devices and services, as well as its domain name portfolio team. Steve was the first intellectual property counsel at Twitter, where he managed the trademark, marketing and domain name practices, among other things.

Bibiana is a Foreign Legal Consultant at Coates IP. Bibiana specializes in trademarks, copyright and domain names. Bibiana’s trademark practice extends back 20 years and has covered the US, Latin America, and the world. Bibiana has worked in important law firms in Colombia (Baker & McKenzie and Olarte Moure), Mexico (Arochi & Lindner), and the US (Crowell & Moring, Baker & McKenzie NY, Venable LLP). She was also Trademark Counsel for Latin America at PepsiCo, Inc.

Her experience includes management of US and worldwide trademark portfolios, drafting of license, video game developing, and distribution agreements, preparation and implementation of IP protection, enforcement and anti-counterfeiting strategies. Bibiana is an associate member of INTA and participant of the INTA Brands Restrictions Committee. She is also a member of ASIPI and acts as a member of the Board of Directors of AIPF.

Bibiana has a law degree from Universidad del Rosario in Bogota, Colombia (1999) and an LLM in Intellectual Property from Franklin Pierce Law Center (today, University of New Hampshire) (2000).
