Program Summary

This seminar explores the attorney-client relationship between a law firm and a community association. The particular focus is on the lawyer’s duties to the association when the association’s leadership acts to the detriment of the association. Practical solutions and compliance with ethical obligations based on the ABA model rules are discussed.

Key topics to be discussed:

  • ABA Model Rules of Professional Conduct governing the representation of an entity client such as a homeowners or condominium association
  • Ethical responsibilities when a conflict arises between the association and an officer and director
  • The lawyer’s duties when an association or its officers and directors engage in conduct that is criminal, fraudulent, or in violation of legal obligations
