This session provides a comprehensive overview of the Trafficking Victims Protection Reauthorization Act, tracing its evolution from a 2000 criminal statute to the 2003 addition of a private civil cause of action. Participants will learn how the 2008 expansion created liability for those who knowingly benefit from trafficking ventures, triggering a wave of litigation against hospitality-industry businesses.
This session examines emerging trends in TVPRA litigation, including the landmark Apple case addressing venture definitions and extraterritoriality. Participants will explore how courts have interpreted the statute’s application to global supply chains and the ongoing efforts to consolidate cases through multi-district litigation.
This session analyzes the multiple insurance policies that may respond to TVPRA claims, including Commercial General Liability, Errors & Omissions, and Employment Practices Liability coverage. Participants will learn about coverage hooks such as bodily injury, personal injury offenses like false imprisonment, and third-party discrimination coverage.
A brief intermission allowing participants to refresh before the final sessions. Use this time to review materials and prepare questions for the upcoming coverage defense analysis.
This session explores the primary defenses insurers assert when denying TVPRA coverage, including expected or intended injury, abuse and molestation, and assault and battery exclusions. Participants will examine the critical distinction between the duty to defend and duty to indemnify, and how the TVPRA’s negligence-based standard affects exclusion applicability.
This session surveys pivotal judicial decisions shaping TVPRA insurance coverage, including Northfield, Riccio v. Bijal, Travelers v. Salesforce, and the Samsung case. Participants will analyze how courts have interpreted policy language and the emerging public policy debate over insurability of trafficking-related claims.
