The Uniform Public Expression Protection Act has rewritten defamation practice in every state that has adopted it, collapsing the timeline between filing and dismissal into a sixty-day gauntlet that punishes generic pleading and rewards procedural fluency. With fourteen states now operating under the uniform framework and more legislatures considering adoption in 2026, plaintiffs’ counsel who draft on pre-UPEPA templates expose their clients to mandatory fee-shifting under Section 10, while defense counsel who treat the special motion as a standard 12(b)(6) forfeit the automatic discovery stay and the burden-shift built into Section 7. This program maps the statute section by section — the Section 4 stay and its narrow discovery exception, the Section 5 hearing clock, the Section 6 evidentiary record, the Section 7 burden allocation, and the Section 10 fee structure — and walks through commercial speech and government enforcement carve-outs, actual malice pleading under Harte-Hanks, and Hensley lodestar apportionment. Requirements

The Alabama State Bar MCLE Commission requires attorneys to complete 12 credits, including 1 ethics, by December 31 of each year. All credits must be reported by February 15 of the following year. A maximum of 12 credits, including 1 ethics credit, may be carried over for 1 year only.  

Formats

  • Attorneys can earn unlimited “live” credit through live seminars, live webcasts, and co-sponsored locations with MyLAWCLE-Alabama approved programs
  • Attorneys are limited to 6 credits per compliance period of “online” programs through MyLAwCLE On-Demand programs
