When a student uses AI to generate nude images of classmates, the district’s first fourteen days decide whether the incident is contained or becomes a federal lawsuit. This session gives district counsel a working playbook for that window: navigating mandatory child-abuse reporting, recognizing what Title IX and the TAKE IT DOWN Act require in the first 24 hours, preserving evidence without unlawfully retaining CSAM, and managing family notification and discipline. Drawing on real incident failures, including Lancaster Country Day School, we show where districts create their own liability, and how counsel prevents it.

This session walks defense counsel through the Title IX deliberate-indifference, state negligence, and Section 1983 claims now being filed over student-generated deepfakes, using the Lancaster Country Day School federal complaint as a live template. We examine how Davis v. Monroe applies to AI imagery, the sovereign immunity, superseding-cause, and Monell defenses available to public districts, and how to position the district’s response record as its primary defense.
