Course Overview

Fabricated authority now cuts both ways — the question is who catches it first.

2026-10-09 14:30:00

Generative AI has moved from novelty to daily research tool, and the ground rules have moved with it. ABA Formal Opinion 512 and a spreading patchwork of local AI-disclosure rules now define what competent, candid use of these tools requires. Courts are no longer treating fabricated authority as an innocent mistake.

File a brief with a hallucinated citation and Rule 11 exposure follows. Miss a fabricated case in an opponent’s filing and a decisive sanctions vehicle goes unused. Choose the wrong framework — Rule 11, 28 U.S.C. § 1927, or inherent power — and the motion fails on procedure. Ignore a local disclosure rule and the liability compounds.

You leave with practitioner work product, not theory. For your own filings: a six-step verification protocol, a repeatable pre-filing checklist, and a documented, defensible workflow. For your opponent’s: a replicable litigation playbook running from the first suspicious citation through a sanctions motion or bar referral. No AI tool exercises that judgment for you — this program shows you where it must be applied.

Six-Step Verification Protocol
A repeatable pre-filing checklist covering citation existence, holding accuracy, quotation fidelity, and subsequent history, integrated into a documented office workflow.
03
Ethics and Disclosure
What ABA Formal Opinion 512 and evolving local AI-disclosure rules require attorneys to do — and to document — before filing.

Sanctions Landscape and Vehicles
What courts are imposing and why, and how to select among Rule 11, 28 U.S.C. § 1927, and inherent-power frameworks in a given fact pattern.
05

The textual and citation-level signals that distinguish genuine AI confabulation from ordinary citation error in an opposing brief.

A Repeatable System for Verifying AI-Generated Citations and Holdings

This session equips attorneys with a structured, six-step verification protocol for AI-generated legal research, covering citation existence, holding accuracy, quotation fidelity, and subsequent history. Attendees will learn how leading AI tools—including legal-specific platforms—fail, what the current sanctions landscape requires of them, and how to build a defensible, documented workflow before any AI-assisted brief leaves the office. Attorneys completing this session will be able to identify the specific failure modes of generative AI in legal research, apply a repeatable pre-filing checklist, and select the right verification tools for their practice.

Catching AI Hallucinations in an Opponent's Brief and Litigating What Follows

This session equips litigators to identify fabricated or distorted AI-generated authority in opposing briefs, select the correct sanctions vehicle, and execute the procedural steps that follow discovery of a hallucination. Attorneys will learn the red flags that distinguish genuine AI confabulation from ordinary citation error, the Rule 11, § 1927, and inherent-power frameworks courts have applied, and how local AI-disclosure rules create compounding liability. Attendees leave with a replicable litigation playbook — from the first suspicious citation through a sanctions motion or bar referral.
