This session examines the specific criteria the IRS requires before considering withdrawal of a notice of federal tax lien. Participants will learn about the direct debit installment agreement requirements, the $25,000 threshold, and the three-payment minimum, along with strategies for negotiating to prevent lien filing in the first place.
This session explores the critical distinction between the statutory ‘silent’ lien that arises automatically under Code Section 6321 and the filed notice of federal tax lien. Participants will understand how the lien attaches to all taxpayer assets, the 10-year collection statute, and why the IRS prioritizes filing notices of lien.
A short break to refresh before continuing with the remaining material.
This comprehensive session covers the three primary mechanisms for dealing with tax liens on property: discharge, subordination, and withdrawal. Participants will master the critical concept that the IRS’s interest equals the taxpayer’s equity, learn the documentation requirements for Form 14135 (discharge) and Form 14134 (subordination), and understand how to navigate short sales and refinance transactions.

Requirements
The Alabama State Bar MCLE Commission requires attorneys to complete 12 credits, including 1 ethics, by December 31 of each year. All credits must be reported by February 15 of the following year. A maximum of 12 credits, including 1 ethics credit, may be carried over for 1 year only.
