Course Overview

FCRA Liability No Longer Stops at the Credit Report

2026-12-15 14:30:00

FCRA practice no longer begins and ends with a credit bureau’s error. Background checks, tenant screening, and automated decision-making now generate claims beyond traditional credit reporting. Algorithmic screening built on consumer data is creating emerging liability for consumer reporting agencies, furnishers, and users of consumer reports.

Plead harm loosely, and standing challenges under Spokeo and TransUnion can end the case early. Misread how the CRAs correspond with furnishers, and investigation failures go unproven. Skip third-party discovery, and the class may never be established. Leave individualized issues unanswered, and commonality and predominance fail. Misjudge willfulness, and statutory, actual, and punitive damages are misvalued.

You will walk out with a practical framework for evaluating FCRA claims, from intake and evidence through pre-suit disputes and complaint strategy. You will learn to plead concrete harm, obtain third-party discovery, and build certification arguments on commonality, predominance, and class definitions. You will also evaluate exposure, class relief, and litigation risk at resolution, using judgment no template or automated tool can supply.
