This session examines the 2018 Farm Bill’s hemp legalization model and how the ‘intoxicating hemp loophole’ emerged from the statutory framework. Participants will learn about the 2025 appropriations bill amendments that transition to a total THC standard, impose a 0.4 milligram per-container cap, and exclude synthetic cannabinoids from hemp status with a 12-month compliance runway.

Jim KofordThis session analyzes which product categories will lose hemp status under the new federal definition, including delta-8 derivatives, high-THC edibles, and full-spectrum CBD products exceeding the cap. Practitioners will explore compliance strategies for manufacturers during the transition period, retailer exposure concerns, and near-term enforcement and litigation risks to monitor.

The Alabama State Bar MCLE Commission requires attorneys to complete 12 credits, including 1 ethics, by December 31 of each year. All credits must be reported by February 15 of the following year. A maximum of 12 credits, including 1 ethics credit, may be carried over for 1 year only.
