The ink was barely dry on the June 6th House settlement when the first legal challenge emerged: an appeal by eight female athletes contesting the settlement’s compliance with Title IX. Crucially, this challenge targets only the backpay damages portion, leaving open the possibility of future litigation over how institutions implement the injunctive relief and revenue-sharing measures. At the same time, a separate lawsuit involving the University of Wisconsin and the University of Miami underscores the growing complexities of enforcing NIL contracts when deals fall apart. Although the House settlement establishes a new framework for college athletics, the litigation cycle continues—raising critical questions around Title IX, antitrust exposure, and contract enforcement.
