Crafting a compelling trial strategy requires an understanding of the rules governing litigation, whether uniform, federal, local, or standing orders. This CLE explores the critical stages of trial, from jury selection—where cases can be won or lost—to the power of opening statements, leveraging primacy and recency effects, cognitive dissonance, and confirmation bias. Participants will gain insights into the significance of jury charges and how they can shape case outcomes, as well as best practices for persuasive closing arguments. The program will also examine key differences between state and federal courts, the nuances of jury and non-jury trials, and the strategies that drive successful litigation.
