This session teaches attorneys how to surface the full marital estate before leverage calcifies — covering what information to collect early, how to follow control and cash flow, and why title is often just a starting point.
Attorneys work through a practical framework for determining whether property is marital, separate, or hybrid, with emphasis on how timing, source of funds, and conduct reshape classification outcomes and how to handle tracing and commingling.
This session equips counsel to choose valuation approaches that survive scrutiny, understand the assumptions that drive outcomes, and evaluate or challenge common discounts and adjustments with credibility needed for both settlement and trial.
Attorneys will learn how to use targeted discovery and depositions to lock down admissions, test opposing experts, and convert the valuation record into settlement leverage or a compelling trial presentation.
