Both the lending and insurance worlds see LLCs very differently than their view of individuals as borrowers or insureds. This session will discuss critical considerations when advising anyone about the use of entities. This session will include key concerns, what to consider, and practical steps that those with, or in the process of establishing LLCs and other entities can consider.

Session V – LLC Liability in the Age of Short-Term Rentals: Legal Risks and Municipal Enforcement – Dov A. Treiman

In a short presentation, Mr. Treiman presents a survey the key issues LLC landlords, tenants, and travelers face in use of a someone’s normal apartment for short term accommodations. As a number of municipalities across the nation have sought to restrict or prohibit these short term uses, all three categories of persons and the attorneys who represent them need to know the legal and physical hazards such uses present to LLC’s and their owners, including massive fines, evictions, and people being stranded outside a locked apartment door as they stare at their luggage, realizing that their vacation just collapsed. Mr. Treiman will use New York City as his focus but will present issues that have become both national and international in scope.

Requirements

The Alabama State Bar MCLE Commission requires attorneys to complete 12 credits, including 1 ethics, by December 31 of each year. All credits must be reported by February 15 of the following year. A maximum of 12 credits, including 1 ethics credit, may be carried over for 1 year only.  

Formats

  • Attorneys can earn unlimited “live” credit through live seminars, live webcasts, and co-sponsored locations with MyLAWCLE-Alabama approved programs
  • Attorneys are limited to 6 credits per compliance period of “online” programs through MyLAwCLE On-Demand programs
