This session examines the structural limitations of the H-1B visa system, including the cap and lottery mechanics, the new $100,000 fee and ongoing litigation, and weighted wage-level selection rules. Participants will also explore travel ban impacts, the benefits pause affecting 39 countries, social media vetting requirements, and critical DOL compliance risks.
This session provides a comprehensive overview of viable H-1B alternatives including O-1 extraordinary ability visas, TN status for Canadian and Mexican citizens, E-1/E-2 treaty visas, and the E-3 for Australians. Attendees will learn about H-1B cap exemption strategies through affiliated institutions, concurrent employment models, and J-1 exchange visitor program opportunities.
This session explores alternatives when U.S.-based visa options are unavailable, including offshore employment arrangements and foreign affiliate placements. Participants will examine compliance considerations such as foreign tax obligations, permanent establishment liability, and how overseas assignments can position employees for future L-1 classification and EB-1C green card eligibility.
This session focuses on minimizing organizational reliance on H-1B visas through strategic workforce planning and understanding dual intent doctrine across visa categories. Attendees will explore how corporate restructuring affects immigration status, state-level sponsorship restrictions, and ethical considerations when employer and employee interests diverge over time.
