Why this

Attorneys advising real estate clients must understand cost segregation and bonus depreciation strategies to protect client interests amid sweeping legislative changes that directly affect commercial property deductions and transaction structuring.
550%
Is how much a cost segregation study can increase first-year depreciation deductions on a residential rental property acquired after January 19, 2025, compared to standard straight-line depreciation, fundamentally altering a client’s tax position at closing.
$560B
In total U.S. commercial real estate transaction volume was recorded in full-year 2025, a 14.4% yearover-year gain, meaning attorneys advising on acquisitions and dispositions face an unprecedented volume of deals where depreciation strategy is now outcome-determinative.
40%
Of a commercial property’s total cost basis can be reclassified into shorter 5-, 7-, or 15-year depreciation schedules through a cost segregation study, making precise component identification and legal documentation central to every commercial acquisition.
19.9%
Of all 1031 exchanges in 2024 involved Delaware Statutory Trust transactions, nearly double 2023’s share, signaling that attorneys must understand how depreciation recapture intersects with disposition vehicles at the time of sale or exchange.
