Vessel Employer Defense: Winning Seaman Status Summary Judgment and Ending Maintenance and Cure Without Punitive Exposure

After Ward v. M/Y Utopia IV, delay alone can prove willfulness. Learn to build a seaman-status summary judgment record from dispatch logs and charter documents, set a defensible maintenance rate, investigate suspected concealment, and resolve IME-versus-treater MMI disputes without punitive exposure.

Course Overview

The claims file is now the willfulness exhibit

2026-11-19 14:30:00

The 2025 Ward v. M/Y Utopia IV fee-entitlement order changed the calculus for vessel employers. A willfulness finding on delay alone carried fee entitlement. Defense lawyers advising vessel owners, operators, and Protection and Indemnity (P&I) insurers now face two urgent Jones Act decisions with less room for error.

Contest seaman status with a thin record, and Santee II shows how a record that looked sufficient loses the nature factors. Argue non-seaman without confirming coverage, and the LHWCA fork catches you. Pay maintenance and cure at an unreviewed rate, and the Hall comparison test exposes it. Terminate on an IME opinion that conflicts with the treater, and the claims file becomes the trial exhibit.

This program delivers the record-building method and the claims judgment that no checklist alone supplies. Attendees leave with a status-record checklist, an LHWCA-fork pre-motion questionnaire, and a maintenance-and-cure decision tree. They also take home a maintenance-rate worksheet built on Hall, a reservation-of-rights paragraph drafted around Boudreaux, and an MMI inquiry letter template.

Key topics that will be covered

01
Reading Santee II’s Record
How the withdrawn and reissued Santee opinions show a defense record losing the nature factors, so your record answers the facts that flipped the allegiance and discrete-task findings.
02
Building the Assignment Log
How to calculate time in navigation and aggregate a fleet from dispatch logs, crew-change data, hitch schedules, MSAs, and vessel ownership and charter records.
03
Scoring Nature Factors by Worker Type
How the 2025 Bommarito and Stringer district templates guide which Sanchez nature factor to lead with for each worker type.
04
Timing and the LHWCA Fork
When to seek severance or expedited cross-motions while the law shifts, and how to confirm LHWCA coverage before arguing non-seaman.
05
The Claims File as Exhibit
How Ward v. M/Y Utopia IV turned delay alone into a willfulness finding, and what the file must hold before you pay, investigate, or terminate maintenance and cure.
06
Making the Call in Three Scenarios
How to set a defensible maintenance rate under the Hall comparison test after a new surgical recommendation, investigate suspected concealment around Boudreaux without reading as bad faith, and resolve an IME-versus-treater MMI conflict.

Building the Seaman Status Summary Judgment Record for Mixed Land and Vessel Workers

This hour is for the defense lawyer who must advise a vessel employer, operator, or P&I club this week whether to contest seaman status for a mixed land-and-vessel worker. It shows how to build the nature-of-connection record from dispatch logs, crew-change data, hitch schedules, MSAs, and vessel ownership and charter records. It uses Santee II, Bommarito, Stringer, and Clapp to separate records that win from records that lose. Attendees work a sample assignment log to calculate time-in-service and score the three Sanchez nature factors, and they leave with a status-record checklist and an LHWCA-fork pre-motion questionnaire.

Making the Maintenance and Cure Call on Incomplete Medical Facts Without Punitive Exposure

This hour is for the defense lawyer who must tell a P&I club or vessel employer this week whether to pay, investigate, or terminate maintenance and cure before the medical picture is clear. Working from the 2025 *Ward v. M/Y Utopia IV* fee-entitlement order, where a willfulness finding on delay alone carried fee entitlement, the session covers three mid-claim scenarios: a new surgical recommendation, a suspected concealed prior injury, and an MMI opinion from an IME that conflicts with the treater. Attendees make the call in each scenario and leave with four tools: a decision tree, a maintenance-rate worksheet built on the *Hall* comparison test, a reservation-of-rights paragraph drafted around *Boudreaux*, and an MMI inquiry letter template.
