Attorneys who fail to anticipate SSD–workers’ comp offsets risk malpractice exposure, damaged client relationships, and forfeited fees.
8.6M
SSDI beneficiaries were in payment status in December 2024 — every concurrent workers’ comp recipient faces potential offset exposure.
34%
of disabled-worker SSDI beneficiaries carried a musculoskeletal diagnosis in 2024 — the same condition category dominating workers’ comp claims.
25%
of past-due benefits is the attorney fee cap — an unchecked offset that shrinks back pay directly cuts attorney compensation.
$1,580
is the average monthly SSDI benefit in 2025 — an amount the 80% offset rule can reduce to zero when workers’ comp payments are high enough.
