Course Overview

The First Federal Decisions Have Landed

Three federal courts have now ruled on whether attorney-client privilege and work product protection survive client and counsel use of generative AI, and the trilogy — Heppner in the Southern District of New York, Warner in the Eastern District of Michigan, and Morgan in the District of Colorado — has done more to define the privilege analysis in six months than commentary has in three years. The platform’s terms of service, whether counsel directed the use, whether the tool was treated as a “party” or a “person,” and whether the protective order anticipated AI use are now outcome-determinative. Every litigator whose client touches a consumer-grade AI tool, and every in-house team running an enterprise deployment, is already exposed. This program walks the platform-by-platform contractual analysis across OpenAI, Anthropic, and Microsoft Copilot, builds a concrete AI governance playbook with tiered policies and Rule 502(d) protections, and dissects the Heppner three-pillar holding alongside Warner and Morgan on the “tools, not persons” framework. Attendees will be able to advise on platform selection, document counsel direction, and assess when AI-assisted work survives discovery.
