Course Overview

The Probate Bench Doesn't Forgive a Federal Misstep

Probate procedure and the federal transfer tax system collapse on each other the moment a client dies, and the practitioners who get caught are rarely the ones who specialize — they’re the litigators, business lawyers, and general practitioners who agreed to “help with mom’s estate” and discovered too late that the testate-versus-intestate path, the sale of real property during administration, and the federal estate, gift, and generation-skipping transfer rules all operate on independent tracks that punish improvisation. The 2026 sunset trajectory of the elevated federal exemption, ongoing IRS scrutiny of valuation positions, and the steady volume of contested administrations have made foundational fluency non-negotiable for any attorney advising on a decedent’s affairs. This program compresses the working architecture into two hours — probate alternatives, the testate and intestate process, unique procedures including real property sales and interim distributions, the traps that catch the wary and unwary, and the federal estate, gift, and generation-skipping transfer tax framework through estate tax return basics. Attendees will leave able to spot exposure, allocate work, and draft pre-death transfers with confidence rather than guesswork.
