Program Summary

Many winnable trials are lost because evidence is excluded, or is admitted for the wrong purpose, or is weak when it could be strong, or maybe was never pursued or adduced in the first place. This presentation talks about the meticulous process of assembling a successful case. Dan discusses some of his own trial triumphs and disasters and the many mistakes and omissions it is possible to make, particularly in the era of electronically stored information (ESI) when so many new types of evidence are available.

Key topics to be discussed:

  • How to find evidence during discovery and depositions and make it admissible
  • Getting your evidence in and keeping theirs out
  • Hearsay exceptions and how they have changed in the digital era
  • Aside from Dan’s own experience, some recent and relevant case law
