The Evidentiary Floor Has Shifted Under Litigators

The mechanics of evidentiary practice have outpaced the templates most litigators learned in their first years at trial. Authentication of digital exhibits and ESI now turns on technical questions earlier generations never had to answer, the Confrontation Clause has been reshaped by Crawford and its progeny — most recently the Supreme Court’s 2024 decision in Smith v. Arizona, hearsay rulings cut harder against unprepared counsel, and the ethics rules covering spoliation, witness preparation, false testimony, speaking objections, and generative AI have expanded where a litigator can step wrong. Trial lawyers operating on aging outlines are exposing clients and themselves at deposition, in limine, and at the bench. Richard D. Friedman is the Alene and Allan F. Smith Professor of Law at the University of Michigan Law School, where he is recognized as an expert on evidence and Supreme Court history. He joined the Michigan Law faculty in 1988 from Cardozo Law School and has remained a central figure in the evidence community ever since. Requirements

The Alabama State Bar MCLE Commission requires attorneys to complete 12 credits, including 1 ethics, by December 31 of each year. All credits must be reported by February 15 of the following year. A maximum of 12 credits, including 1 ethics credit, may be carried over for 1 year only.  

Formats

  • Attorneys can earn unlimited “live” credit through live seminars, live webcasts, and co-sponsored locations with MyLAWCLE-Alabama approved programs
  • Attorneys are limited to 6 credits per compliance period of “online” programs through MyLAwCLE On-Demand programs
