Cognitive Bias Now Decides Verdicts Before Evidence Does

Jurors decide cases through cognitive shortcuts, confirmation bias, anchoring, hindsight reconstruction, and in-group affinity long before they weigh the record, and trial lawyers who still build voir dire around demographics and gut instinct are losing strikes on jurors whose attitudes, not their backgrounds, will sink the case. Reptile-theme plaintiff strategies, escalating damages anchors, and post-pandemic juror skepticism have made attitudinal screening the difference between a defensible verdict and a runaway one, and courts continue to compress voir dire time while expanding the latitude given to supplemental juror questionnaires. This 90-minute program maps the biases that drive deliberation dynamics through the Story Model and primacy-recency framing, then translates focus group and mock trial findings into a working strike profile covering questionnaire design, open-ended questioning, looping technique, the funnel method for surfacing concealed bias, and locking in cause challenges. Requirements

The Alabama State Bar MCLE Commission requires attorneys to complete 12 credits, including 1 ethics, by December 31 of each year. All credits must be reported by February 15 of the following year. A maximum of 12 credits, including 1 ethics credit, may be carried over for 1 year only.  

Formats

  • Attorneys can earn unlimited “live” credit through live seminars, live webcasts, and co-sponsored locations with MyLAWCLE-Alabama approved programs
  • Attorneys are limited to 6 credits per compliance period of “online” programs through MyLAwCLE On-Demand programs
