Course Overview

At 18, a parent’s decision-making role can change completely

2026-12-04 12:00:00

Turning 18 marks the transition to legal adulthood for an individual with disabilities. It can fundamentally change how parents and caregivers take part in legal, medical, financial, and other important decisions. The same transition brings adult SSI and Medicaid eligibility, with new considerations involving income and assets.

Choose full guardianship where limited authority would do, and the individual’s autonomy and rights are at stake. Skip planning for legal authority, and medical, educational, and adult-service decisions stall. Let an inheritance pass directly to the individual, and benefits eligibility can suffer. Ignore future caregiver changes, and long-term stability is at risk.

You walk out with a framework for assessing full versus limited guardianship and weighing less restrictive alternatives. You learn how supported decision-making and powers of attorney set the appropriate level of authority. You leave ready to coordinate SSI, Medicaid, and family support through first-party and third-party special needs trusts. Each family needs these judgment calls made case by case.
