Program Summary

This CLE will provide approaches and practice tips for guiding a client through the divorce process in a way that maintains the mental health of their child by keeping them at a safe distance from the proceedings. We will discuss healthy ways to inform the child that the divorce is taking place without subjecting them to the stress of the process or alerting them to hostilities between the parties. The CLE will address how to handle these issues with young children, who may not yet know what divorce is, to older children and teenagers, who may ask detailed questions. While the focus will be to handle the divorce process without involving the children or discussing any conflicts that may arise, we will also cover when it may be time to involve a guardian ad litem and how to discuss this with the child.

Key topics to be discussed:

  • Advising your client on how to inform the child of the divorce (when and how)
  • Advising your client not to discuss any court proceedings with the child
  • How to tailor your approach to the child’s age
  • Preventing your client’s emotions from financially harming the child
  • Ensuring your client does not villainize the other party
  • Advising your client not to set expectations with the child while proceedings are still pending (parenting time, vacation time, school arrangements, etc.)
  • When to introduce a guardian ad litem and how to discuss this with a child

Date / Time: August 23, 2023
