Session III - Outline of Health Care Facilities – Michael A. Brusca

The intersection of acute-care, long-term and rehab care is a complicated subject that is confusing to navigate. This lecture seeks to clearly explain the continuum of care - i.e. the different types of facilities and the level of care they provide, as well as the data available in assessing these facilities, how to spot trouble, and what to do when problems arise.

Bryson Eubanks_myLawCLEBryson Eubanks | Clements & Eubanks, PC

At a young age, Bryson witnessed his family caring for his great-grandmother. The formative experience inspired his career path into elder law. He runs his business to help families support each other, and he treats all of his clients like family. After playing baseball for Carson-Newman University, where he earned a Bachelor of Arts in Psychology, Bryson received his Masters of Arts in Gerontology from Appalachian State University. He then began a fulfilling career as a public benefits specialist, learning firsthand how the law could help families navigate the challenges of aging.

In 2019, Bryson earned his Doctor of Jurisprudence from the Nashville School of Law. He joined Clements Law Firm in 2024, expanding the practice to Nashville. Bryson brings a unique blend of compassion, expertise, and firsthand experience to the team. His background in psychology and gerontology equips him with a deep understanding of the emotional and practical aspects of aging, allowing him to provide holistic support to his clients. Bryson is a member of the Tennessee Bar Association and numerous community organizations. When not in the office, he enjoys spending time with his wife, a fellow attorney, and their two young children.

A native of Chattanooga, Drew graduated from Lee University with honors in political science. Then, graduating fourth in his class from the Nashville School of Law, he received his Doctor of Jurisprudence, with high honors and was admitted into the school’s honor society, Cooper’s Inn, for finishing in the top ten percent of his class. After working briefly for a medical malpractice defense firm in Nashville while in school, Drew returned home to Chattanooga to focus on an elder law and family law practice.

Drew mainly helps clients in probate and estate planning as well as divorce/custody matters. However, Drew also aids clients in business planning, landlord/tenant issues (both commercial and residential) and personal injury. His personal commitment as your legal representation is to work diligently, timely and cost-efficiently, knowing that no matter the situation, you are facing a period of overwhelming change.

Drew is a member of the Tennessee Bar Association’s Elder Law Executive Council, serving as the Vice Chair for 2023-2024 and as the Section Chair for 2024-2025. A proud member of the BNI Powernet Chapter, Chattanooga Bar Association, and Rotary Club of Chattanooga at Hamilton Place, Drew enjoys serving on a number of social and service clubs. Drew is licensed in both Tennessee state and federal courts surrounding the Chattanooga area where he is ready to make your legal journey as simple and affordable as possible. When he’s not in the office, Drew pulls for the Braves and enjoys golfing, hiking, and good food with his wife and family.

Since 2009, Michael has devoted his practice to representing vulnerable people and their families in abuse, neglect, and death cases in nursing homes, rehabs, assisted living facilities, group homes, and hospitals. He is one of a select few lawyers in New Jersey to truly concentrate their practice in this area. He shares his knowledge on this important topic by regularly lecturing around the country and teaching other lawyers to prosecute these claims the right way. He has also been consulted by reporters and law enforcement in this field.

Michael has been published many times, including in the New Jersey Law Journal and in “Trial” – the national attorney magazine published & disseminated by the American Association for Justice. He is the past chairman of the Executive Board of the National Nursing Home Litigation Group for the American Association for Justice. Michael brings a unique perspective to his work. He himself has lost family members in institutions and he knows, first-hand, what it’s like to see someone you care about struggle and die. He uses that passion and understanding to bring about justice for his clients.

Michael is a highly skilled and experienced advocate. Prior to entering private practice, Michael served as a Judge Advocate in the United States Air Force, where he tried many cases all over the world, including Japan, Qatar and Kuwait. In New Jersey, he was lead counsel for the plaintiff in the case of Dwyer v. Harborview, which generated the largest nursing home verdict to date: $13.2 Million. While the verdict was later the subject of post-trial motions and an appeal, and ultimately settled for a different amount, the results demonstrate Michael’s considerable skill in the courtroom. Please note, every case is unique, and no specific case or outcome can predict future results.
