Program Summary

In this webinar, attendees will learn practical suggestions and strategies for avoiding common ethical pitfalls. The old adage that “an ounce of prevention is worth a pound of cure” is readily applicable in the legal profession, and nowhere is that more true than in learning good habits for communicating appropriately with one’s clients, and being good fiduciaries when it comes to taking care of their money. At this webinar, you’ll learn the building blocks for those habits: how to draft an effective letter of engagement, how to respond to client inquiries, how to communicate clearly by avoiding excessive legalese. You’ll also learn the “five commandments” for appropriate management of client funds in your possession. These strategies and tips are designed to lower your risks of falling into these ethical traps and professional liability sinkholes.

Key topics to be discussed:

  • Setting clients’ expectations appropriately through the use of engagement agreements
  • Best practices for management and stewardship of clients’ funds
  • Effective communication with clients and prospective clients, including declining and terminating representation
  • Defining who the client is in particular types of representation
