Private equity transactions in the healthcare industry involve a myriad of issues not encountered in transactions with other industries. Federal and state laws, rules and regulations specific to healthcare such as licensure concerns, the corporate practice of medicine doctrine, fraud and abuse, confidentiality and HIPAA are healthcare specific and must be recognized early in the process. Payer concerns, employment, antitrust and other miscellaneous matters unique to the healthcare industry entity will also impact the ability to structure a successful transaction. He is an Adjunct Professor at Baylor University School of Law and Baylor University’s Hankamer School of Business, Robbins Institute of Health Policy & Leadership MBA program. He is a frequent speaker and author on subjects in the healthcare industry including those issues pertaining to healthcare transactional matters.
Mr. Souter obtained his BBA in Finance and Juris Doctorate from Baylor University, his MBA in Health Services Management from the University of Dallas and his LLM in Health Law from Hofstra University.
