Session II - Risk, Regulation & Resilience: What every lawyer needs to know about legal ethics and well-being - Tracy Kepler

Why does attorney well-being matter and why should we be thinking of our well-being as a risk management or legal ethics best practice? Mental health issues and substance use disorders can affect any attorney, in any setting, and at any time. Left untreated, they can destroy careers and lives. To many in the legal profession, the term “lawyer mental health” may seem like a contradiction in terms. The demanding hours and stressful work environments have detrimental effects on lawyers and paying attention to one’s own well-being seems to get pushed to the last item on the to-do list. To be a good lawyer, one has to be a healthy lawyer. Sadly, our profession is falling short when it comes to well-being. During this program, we will examine the risk management and legal ethical implications for lawyers and their law firms, including but not limited to MRPC 1.1, 1.3, 1.4, 1.16, 5.1 and 8.4, preventative measures, and proposed policy and well-being initiatives, that lawyers in any practice setting may implement to protect clients as well as save careers.

Blake Harris is the founding principle at Blake Harris Law, where he assists clients throughout the world with Asset Protection. Blake’s extensive experience helping families protect their property has made him well regarded as an authority in handling the difficult and sensitive issues surrounding asset protection planning.

Before Blake Harris Law, Blake worked for one of the nation’s largest wealth management firms, where he helped high-net-worth and ultrahigh- net-worth clients protect their assets. Blake founded Blake Harris Law because he is passionate about helping families protect their wealth and pass it to the next generation. Not only does he value building long-lasting client relationships, he also strives to provide each client with peace of mind about their assets.

In addition to his active practice, Blake also strives to share his in-depth knowledge to help other professionals advance in their careers. Across the nation, Blake has given numerous presentations and continuing education lectures on asset protection and estate planning to CPAs, financial advisors, and other attorneys. Blake has been quoted in state-wide and national publications, such as ABC, NBC, CBS, Fox News, The Denver Post, and Market Watch, and he has been named a “Rising Star” for 2020, 2021, and 2022 by Super Lawyers Magazine. Blake is also the author of the book “Asset Protection, How to Protect Your Property from Lawsuits”.

Blake graduated in 2007 with a degree in Finance from the University of Florida and received a Juris Doctorate in 2010 from the University of Florida Levin College of Law, a top-tier law school.

Blake is the founder of the Blockchain Asset Protection Council and an active member of the American Bar Association and International Bar Association. Blake has been a member in good standing of the Florida Bar since 2010 and the Colorado Bar since 2013.

Outside of work, Blake enjoys traveling and spending time with family.

Tracy L. Kepler is the Risk Control Consulting Director for CNA’s Lawyers Insurance Program. In this role, she designs and develops content and distribution of risk control initiatives relevant to the practice of law. She collaborates with the underwriting and claims teams to develop and execute strategies for the profitable growth of the program. Tracy lectures frequently at CNA-sponsored events and at state and local bar associations and national seminars hosted by industry-leading organizations. She also writes articles focusing on law firm risk control and professional responsibility issues.

Prior to joining CNA, Tracy served as the Director of the American Bar Association’s Center for Professional Responsibility (CPR), providing national leadership in developing and interpreting standards and scholarly resources in legal and judicial ethics, professional regulation, professionalism, client protection, professional liability and attorney well-being. Ms. Kepler has nearly 20 years of experience in attorney regulation as she served as an Associate Solicitor in the Office of General Counsel for the U.S. Patent & Trademark Office (USPTO), where she concentrated her practice in the investigation, prosecution and appeal of patent/trademark practitioner disciplinary matters before the Agency, U.S. District Courts and Federal Circuit, provided policy advice on ethics and discipline related matters to senior management, and drafted and revised Agency regulations. She also served as Senior Litigation Counsel for the Illinois Attorney Registration and Disciplinary Commission (ARDC), where she investigated and prosecuted cases of attorney misconduct.

Ms. Kepler has served in various volunteer capacities, including as President, on the Board of the National Organization of Bar Counsel (NOBC), a non-profit organization of legal professionals whose members enforce ethics rules that regulate the professional conduct of lawyers who practice law in the United States and abroad. Ms. Kepler is currently an Adjunct Professor at American University’s Washington College of Law, Georgetown University Law Center and Loyola School of Law (Chicago) teaching Legal Ethics. Committed to the promotion and encouragement of professional responsibility and attorney wellbeing throughout her career, Ms. Kepler has served on the ABA’s Commission on Lawyers Assistance Programs, is a Board member of the Institute for WellBeing in Law (formerly the National Task Force on Lawyer Well-Being) and is an author of its Well-Being Report. She is also a Board Member of the Mindfulness in Law Society and the Vice Chair of the ABA IPL Section’s Attorney Well Being Committee. She is a graduate of Northwestern University in Evanston, Illinois, and received her law degree from New England School of Law in Boston, Massachusetts.
