Session I - What the Big Beautiful Bill Means for Healthcare Providers: Medicaid, Technology, and Rural Impact – Rachel V. Rose

On July 3rd, the House passed the Senate's version of The Big Beautiful Bill, which was signed into law. One of the most hotly debated aspects of the bill was Medicaid and Rural Health Care implications. The purpose of this segment of the presentation is to highlight key areas as they relate to health care and technology

Session II - Understanding the Major Health Care Provisions in Budget Reconciliation Law - Zachary L. Baron

This session will provide an outline of major health care provisions enacted in the budget reconciliation package signed into law. Among other provisions, the reconciliation legislation will result in severe cuts to the Medicaid program, highly restrict eligibility for marketplace coverage under the Affordable Care Act, and broaden exemptions for orphan drugs under the Medicare drug negotiation program. I will also cover past litigation related to the Affordable Care Act and how broader administrative and constitutional law trends could inform future litigation challenges as the law goes into effect. I will also highlight implementation challenges for federal and state officials in the coming years.

Rachel V. Rose, JD, MBA (Houston, Texas) has a unique background, having worked in many different facets of healthcare, securities, cybersecurity, as well as international law and business throughout her career. For over a decade, her practice has focused on transactional, compliance, and litigation matters related to cybersecurity, health care, securities, and Dodd-Frank/False Claims Act whistleblower claims. She has conducted HIPAA Risk Analyses for a variety of domestic and international organizations and represented persons related to government enforcement inquiries and responses on cybersecurity and healthcare related matters. Ms. Rose worked on Capitol Hill when HIPAA passed in 1996 and worked at HHS in 2009 when the HITECH Act was being implemented.

In addition to being extensively published, a sought-after presenter, and quoted expert, Ms. Rose holds an MBA with minors in healthcare and entrepreneurship from Vanderbilt University, a law degree from Stetson University College of Law, and an Executive Certification in Leadership and Negotiation from Harvard Law School. She is also the co-editor of the American Health Lawyers Association’s Enterprise Risk Management Handbook for Healthcare Entities (2nd Edition), as well as a co-author of the ABA’s books The ABCs of ACOs and What Are International HIPAA Considerations?, as well as various chapters in legal and medical books alike.

She has been named consecutively to the Texas Bar College, the National Women Trial Lawyers Association’s Top 25, Houstonia Magazine’s Top Lawyers (healthcare), the National Trial Lawyers Association’s Top 100, SuperLawyers (healthcare), as well as 1st Healthcare Compliance’s 2019 and 2022 Top Presenter. Ms. Rose is also an Affiliated Member with the Baylor College of Medicine’s Center for Medical Ethics and Health Policy, where she teaches bioethics.

Speaker_Zachary L. BaronZachary L. Baron | O’Neill Institute for National and Global Health Law

Zachary Baron is a director of the Center for Health Policy and the Law at the O’Neill Institute and is an adjunct professor at the McCourt School of Public Policy. He has also served as an adjunct professor at Georgetown Law. He focuses on providing technical assistance for policymakers and public education on health policy legal issues with an emphasis on access to coverage, affordability, transparency, and equity.

Prior to joining the O’Neill Institute, Baron served as health counsel for the Committee on Ways and Means in the U.S. House of Representatives, where his portfolio included health and tax matters, such as coverage provisions under the Affordable Care Act (ACA), surprise billing, and the private health insurance market. He also led congressional investigations on discrimination in the child welfare system, the coronavirus pandemic, and private equity’s expansion in the health care system.

Baron previously served as senior counsel for the Energy and Commerce Committee concerning legal and policy issues related to access to reproductive health care, and as special counsel to the Ranking Member of the Senate Judiciary Committee during a pending Supreme Court nomination. His additional past government experience includes working on regulations and guidance implementing provisions of the ACA at the Centers for Medicare & Medicaid Services.

Baron also served as an attorney in private practice, handling high-profile litigation disputes as well as health regulatory and antitrust matters.

Baron received his J.D. from the University of California, Berkeley, School of Law, and his B.A. from the University of California, Los Angeles.

Mr. March is an experienced tax controversy lawyer who has represented individuals before the Department of Justice in the Federal District Courts of Maryland, Virginia, West Virginia, Delaware, Florida, and the District of Columbia on matters involving allegations of bank fraud, foreign bank account reporting (FBAR) requirements, and tax evasion, among much more. He has managed teams in resolving civil tax controversies in all stages of administrative proceedings before the U.S. Tax Court, as well as in parallel investigations by the IRS, the Department of Homeland Security, and the FBI. He has extensive experience with complex civil litigation and appeals and white-collar criminal defense.

Mr. Halle’s practice focuses on business and corporate law, partnership and individual tax matters, franchising law and corporate transactional matters.

As Co-Chair of Whiteford’s CARES Act committee, Mr. Halle has written numerous articles about the Paycheck Protection Program (“PPP”), keeping the firm and its clients updated on all the latest developments and has guided dozens of clients through the PPP process, representing millions of dollars in PPP funding, including recently successfully appealing a forgiveness denial with $2+ million at stake.
