Session II - Handling Commercial Motor Vehicle Cases – Briant G. Mildenhall

We will discuss how to handle Commercial Motor Vehicle cases and the differences between CMV cases and regular car cases. This will include changes to intake procedure, first steps, timing for filing suit, and taking depositions. We will also discuss key components of the CDL manual and motor carrier federal regulations. We will discuss latest best practices on how to leverage mindset, sequence, and trucking industry safety standards to win your trucking cases in the deposition phase. The focus will be on the preparation for and execution of the key trucking company corporate representative and safety director deposition. We will also review where to find the trucking industry safety standards and how to prove them. The process and techniques taught here are useful not only in trucking cases, but in any personal injury litigation.

Barry P. Goldberg was born, raised, lives and practices in the West San Fernando Valley in Southern California. Mr. Goldberg has gained a reputation as a tenacious and understanding advocate for his personal injury clients. Mr. Goldberg has personally tried many cases to verdict, arbitrated dozens of UM/UIM cases and mediated hundreds of cases over the course of his career. Mr. Goldberg has also become an expert witness on plaintiff personal injury and law office management issues.

His Woodland Hills firm has grown steadily to its current configuration with 3 attorneys and 15 full-time employees. Mr. Goldberg is active in his community serving as President of the San Fernando Valley Bar Association and all the associated charitable organizations and causes. In his spare time, he performs with other attorneys and judges as principal trombonist with the Los Angeles Lawyers Philharmonic Orchestra and the Big Band of Barristers.

Mr. Goldberg is a regular author on various tort and insurance topics. He is also a frequent contributor to the Valley Lawyer Magazine on various topics. He is known mostly for his writings on California Uninsured and Underinsured Motorist Law and Arbitration. His feature Article “Mastering UM/UIM Arbitrations” (Advocate Nov. 2020) received positive acclaim as the plaintiff attorney’s guide to handling UM and UIM cases in California. Affectionately nicknamed by colleagues “The UM Guru” in Southern California.

Briant G. Mildenhall is a Board-Certified trucking attorney at Fried Goldberg in Atlanta, Georgia. He has handled trucking cases in 19 different states and serves on the ATAA Board of Regents. Besides specializing in trucking law, Briant has also dedicated many hours to judicial reform in Eastern Europe. He speaks Russian and has taught trial advocacy skills to law students in Ukraine and Moldova. Briant and his wife live in Roswell, Georgia, with their five children and two dogs, where they enjoy hiking, soccer, and fine pizza.
