Program Summary

Trial is the most adversarial part of litigation, and cross-examination is the most adversarial part of trial. An effective cross will treat a cross as, in Irving Younger’s words, a “commando raid.” Thus, this CLE will cover effective cross-examinations through the lens of a commando raid. We will start with the strategy phase: the goals of cross-examination. We’ll then move to the execution phase, which will be the majority of the CLE. We will conclude with the exit phase: the “sit-down” question.

Key topics to be discussed:

  • The goals of cross-examination
  • The “rules” of cross-examination
  • The (updated) ten commandments of cross-examination

Nick Walter is an associate at Moyes Sellers & Hendricks Ltd. His practice focuses on complex commercial litigation, business law, and trial work. Mr. Walter represents clients in all aspects of litigation, mediation, and arbitration in cases involving numerous claims, including fraud, retaliation, discrimination, harassment, negligence, breach of contract, and faulty construction. His clients range from individuals to large national companies, operating across numerous industries such as construction, energy, education, healthcare, utilities, and real estate. While in law school, Mr. Walter served as an editor on four law journals and competed in numerous moot court and mock trial competitions. He also first chaired ten trials to verdict as a Rule 38 limited practice attorney in a prosecutor’s office. All ten verdicts were convictions. When not at the office, Mr. Walter enjoys playing various sports such as football, softball, and ultimate frisbee, serving in his church, and spending time with his beautiful wife.
