Program Summary

For the practitioner with a working knowledge of most federal consumer financial services laws, this course will dive a bit deeper to provide insight into the most litigated issues as well as practical practice tips for both plaintiff and defense counsel. The course will also cover related privacy and data security issues including the plethora of new state privacy laws. Recognizing the growth of mandatory arbitration requirements in consumer financial services contracts, the course will also discuss strategies to defeat these clauses as well as how to succeed in arbitration if challenges fail.

Helen Mac Murray has been a leader in the consumer protection area for more than two decades. A Founding Partner of Mac Murray & Shuster, she consults with and represents numerous entities regulated by federal and state consumer protection and privacy laws, regularly working with in-house counsel, executive management, and marketing and sales personnel. As a former Chief of the Ohio Attorney General’s Consumer Protection Section, Helen now uses her experience and insights to focus on the defense of state, federal, and multistate consumer protection investigations.

In addition to her defense work, she frequently advises clients on proactively managing their compliance obligations, successfully identifying issues that only a trained “former regulator eye” will catch. Bringing more than a decade of experience in private practice and as an in-house attorney, Erica understands firsthand the challenges and pitfalls businesses face in trying to meet their compliance obligations without impeding operational, financial, and innovation objectives. She advises on applicable federal and state regulatory requirements, industry best practices, and industry self-regulatory regimes. This includes conducting risk assessments, developing and implementing policies and procedures, creating and delivering employee training, conducting ongoing monitoring and testing, responding to issues, and developing meaningful reporting. She has extensive experience with a wide range of existing and emerging consumer protection and privacy laws, including the TCPA, CCPA, FTC Act, UDAP laws, and CANSPAM.
